Terms and Conditions  

For purposes of these Terms and Conditions, the terms “We”, “Us” and “Our” refer collectively to Wooden Hull Press and its respective owners, employees, affiliates, officers, directors, successors, representatives, assigns and also to the exploration leaders of Explore Ikaria 2016.

 

GENERAL INFORMATION FOR EXPLORE IKARIA 2016

Dates: June 23 – 27, 2016

 

Explore Ikaria 2016 Includes: Three walking explorations; visit to hot springs; dining together at restaurants and cafes; village festival (panigiri); visit to Theoktisti Monastery; visit to beaches; visit to a winery; planning information; limited travel insurance  

Explore Ikaria 2016 Does Not Include: flights to/from Ikaria; all meals/food expenses; hotel costs; travel to/from airport or arrival port; passport/ visa fees; all other personal expenses; additional medical coverage according to participant(s) preference

All participants must be 18 years or older, unless accompanied by a parent or guardian

Explore Ikaria 2016 is an active exploration of Ikaria Island that requires some physical activity and moderate level walks in high summer, and full days. Participants should have the ability to walk for up to several hours each day (often on rocky, uneven and loose ground, uphill/downhill routes). This expedition is not suitable for anyone with a serious medical condition or limited mobility. This expedition is also not suitable for anyone who does not like to be or has a medical condition in high altitudes or on windy roads or paths, often without guardrails.

DEPOSITS, REFUNDS AND CANCELLATION POLICY

To reserve a spot in Explore Ikaria 2016, please read these Terms and Conditions, and if you accept them, then send us a reservation request. A deposit of $200 (€190) will be due if you receive a confirmation from us by April 25, 2016 that we have received the required five (5) participants. (If you make a request after April 25, 2016, we will promptly inform you whether we have five (5) participants already.) The confirmation notice will include method(s) of payment for the deposit.

We reserve the right to cancel Explore Ikaria 2016 if there are insufficient registrations (less than five (5) participants) and the trip therefore becomes not economically feasible for us to host it. No deposit will be required prior to a confirmation notice sent to you.

Due to the efforts made to secure all necessary exploration components in advance, once confirmation to you has been given that the exploration will take place, no refunds of deposits received will be granted for any reason other than a cancellation of Explore Ikaria 2016 by Us due to reasons outside of our control.

DOCUMENTATION, HOTELS AND TRAVEL CARRIERS

Participants are responsible for obtaining any documents required for their participation in the expedition such as a valid passport, all visas, vaccination certificates, and any other documents. Failure to obtain documents does not negate any part of provision of these Terms and Conditions, and any extra costs incurred for rerouting due to travel without the necessary documents will be the participant’s responsibility.

Although We are happy to give you planning help on which areas/villages to stay in to suit Our exploration itinerary, accommodations are not included in this exploration. Participants are solely responsible for reserving and booking their own accommodations (hotel or other) during Explore Ikaria 2016. (The price of Explore Ikaria 2016 is kept low in part, so that participants can choose their own level of comfort regarding accommodations.) We are not responsible for any participants who fail to obtain accommodations, who are not pleased with the accommodations they select, or who have any other complaints or problems regarding their accommodations. 

We shall not be liable for any hotel or carrier (e.g., airlines, ferries, vehicles, etc.) cancellation or penalty incurred by participants.

Baggage and personal effects are at all times the sole responsibility of the participant(s).

RULES AND REGULATIONS

 It is important that We and all participants respect Ikaria Island and its local culture and environment. If a participant acts in a way that is injurious to himself or herself, people of Ikaria, other participants on the trip, or breaks any local laws, rules or regulations, or generally conducts himself or herself in a way that is disruptive to Explore Ikaria 2016 or the local environment, we reserve the right to dismiss the participant without refund. Use of any illegal drugs or mistreating the natural environment of Ikaria are also causes of dismissal. Participants dismissed early or who choose to leave for any reason, including sickness, personal emergencies or injury, will be responsible for all medical costs, and will absorb travel and related costs associated with an unscheduled departure.

RISKS INVOLVED WITH THIS EXPLORATION

Explore Ikaria 2016 includes risks associated with foreign travel to a remote island with a diverse natural environment, mountains, winding roads and other physical terrain conditions. Risks may include, but are not limited to, those associated with local transportation, terrain changes, mountain altitudes, locally marked (and sometimes unmarked) footpaths, local transportation, nature walking and trekking, communications issues, accommodations and hotels, unfamiliar foods, and emotional stress due to travel and circumstances which may be unfamiliar to the traveler.

 Participants’ participation in Explore Ikaria 2016 is also subject to conditions related to those contained on a remote island in the Greek Aegean, including capricious winds and changing weather conditions; oceans or other water bodies; stream crossings; currents, waves; falling rocks; hot (geothermal) springs or cold water; falling or fallen timber; stinging, venomous or disease carrying animals or insects; poisonous plants; wild animals and other natural or manmade hazards. Hazards (both on land and above and below water level) may not be visible and weather can be unpredictable year around.

Further risks are detailed in the “ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS & RELEASE AND INDEMNITY AGREEMENT”, which all participants are asked to read and sign prior to participant’s deposit being accept for enrollment in Explore Ikaria 2016.

 HEALTH REQUIREMENTS AND SAFETY CONSIDERATIONS

 This exploration of Ikaria may be rugged at times and requires good physical conditioning. Participants must be in good physical and mental health. Any physical condition, diet, or treatment requiring special attention must be reported in writing when the reservation is made. We cannot guarantee that we will be able to reasonably accommodate all needs. We encourage participants to consult a doctor for specific medical advice about any activities or destinations. If you have any questions regarding the physical demands of a program, please let Us know. We assume no liability regarding provision of medical care. It is the participant’s responsibility to understand the coverage and limitations of the provided medical insurance, and to procure additional medical insurance as needed or preferred.

By registering for Explore Ikaria 2016, the participant certifies that he/she does not have any mental, physical, or other condition or disability that would create a hazard for him/herself or other participants. We reserve the right in our sole discretion to accept, decline to accept, or remove any participant on Explore Ikaria 2016.

MEDICAL AUTHORIZATION,  INSURANCE,  COVERAGE AND EXPENSES

 In the event participant becomes sufficiently incapacitated as to be unable to direct his or her own care, there is no one on Explore Ikaria 2016 who can direct participant’s care, We are unable or do not have time to contact participant’s emergency contact, the participant, by registering and paying a deposit for Explore Ikaria 2016, authorizes any medical treatment deemed necessary in the event of any injury or illness while participating in Explore Ikaria 2016 which is deemed advisable by, and is to be rendered under the general or specific supervision of, a duly licensed physician or other medical professional deemed competent to render the necessary care. 

 It is the responsibility of the participant to understand the limits of the included medical and evacuation travel insurance, and to provide upfront payment of emergency services when required. Each participant is required to read and sign the limited insurance coverage that will be provide prior to the program departure.

In addition to the limited insurance provided, participant certifies upon submitting his/her deposit to Us that s/he has medical insurance which will cover personal accidents, medical expenses, medical evacuation, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to the participant, or that in the absence of this medical insurance coverage, the participant agrees to pay all costs of rescue and/or medical services as may be incurred on the participant’s behalf.

 ITINERARY CHANGES

The itinerary for Explore Ikaria 2016 has been thought out with great care to try to provide an extremely rewarding experience for participants. Every reasonable effort will be made to operate Explore Ikaria 2016 as planned. However, alterations may still occur after final itineraries are sent. We reserve the right, without penalty, to make changes to the Itinerary whenever, in our sole discretion, conditions warrant or if they deem it necessary for accommodating local, conditions, the comfort, safety or convenience of participants.

PHOTOGRAPHER AND VIDEOS

We reserve the right to take photographs or videos during the operation of Explore Ikaria 2016 and to use the resulting photography, videos, or recordings for promotional or commercial use. In addition, we may be photographing during Explore Ikaria 2016 with a drone helicopter. However, any photographs or videos that show your likeness or voice will not be used by Us for our website or any other promotional or commercial purpose without your prior written consent. We shall provide all participants a photo, image/visual likeness and voice release form prior to the start of the exploration, which you are not obligated to sign.

DISPUTE RESOLUTION

If the participant has a complaint, he/she should first inform an exploration leader so that s/he can attempt to rectify the matter. If the participant is still dissatisfied, s/he should submit the complaint in writing to Us within 30 days of the completion of the expedition.

 Any controversy or claim arising out of or relating to these Terms and Conditions, Our website, or any other documents, correspondence or literature concerning Explore Ikaria 2016, or the breach thereof, including without limitation any claim related to breach of contract, tort, illness, injury, or death, shall be subject to the following conditions: (i) the dispute will be governed by the laws of the State of Connecticut, USA; (ii) the parties agree that they will attempt in good faith to settle any and all disputes arising out of, under or in connection with this Agreement, including without limitation the validity, interpretation, performance and breach hereof, through a process of mediation in New Haven, Connecticut, USA under the supervision of a mutually agreed upon mediator; (iii) in the event that mediation fails to settle such a dispute, the parties agree that they will proceed to arbitration in New Haven, Connecticut, USA using one arbitrator pursuant to the then existing rules of the American Arbitration Association; (iv) participants may not file or engage or participate in any class action suit against Us; and (v) the maximum amount of recovery to which a participant will be entitled under any and all circumstances will be the published price (up to $560.00) of the participant’s individual participation in Explore Ikaria 2016. This agreement to arbitrate does not waive or modify any liability release agreed by the participant.

CHANGES TO THESE TERMS AND CONDITIONS

We reserve the right, without penalty or any other obligation owed, to make changes to any part of these Terms and Conditions or to include additional Terms and Conditions whenever, in our sole discretion, conditions warrant or if We deem it necessary for accommodating local, conditions, the comfort, safety or convenience of participants.

Additional Terms and Conditions may also apply to this exploration and will be available to participants prior to the required deposit.

LIABILITY RELEASE

 We shall not be held liable for any damage to, or loss of, financial means, property or injury to, or death of, the participants and any other persons occasioned directly or indirectly by an act or omission by Us or by any other provider and any loss or damage due to delay, cancellation, or disruption in any manner caused by any other conditions, the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, wind, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond our control. The participant waives any claim against Us and/or Our exploration leaders for any such loss, damage, injury, or death.

Further release of liability will be detailed in the “ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS & RELEASE AND INDEMNITY AGREEMENT”, which all participants are asked to read and sign prior to participant’s deposit being accept for enrollment in Explore Ikaria 2016.

 

Participants will be required to read and sign a paper copy of these Terms and Conditions, as well as an  "ACKNOWLEDGEMENT AND ASSUMPTION OF RISKS & RELEASE AND INDEMNITY AGREEMENT" prior to his/her deposit being accepted and participation in Explore Ikaria 2016 is able to occur.
